Maryland First State to Ban Facebook Login Requests

After gathering national attention for the past few weeks, Maryland has become the first state to specifically prohibit the practice of requesting employees’ and applicants’ Facebook login information.

The new law, effective October 1, 2012, prohibits employers from requesting or requiring that employees or applicants provide access information to any personal electronic accounts. It also provides penalties for employers who threaten to take disciplinary action if employees don’t disclose their login information.

Similar legislation is pending in other states as well.
