Federal Court Upholds NLRB Posting Rule

A federal trial judge in Washington, D.C., has ruled that the NLRB has the authority to require employers to post the proposed poster informing employees of their right to organize under the National Labor Relations Act. The deadline for compliance has been pushed back several times, and is now scheduled to take effect April 30, 2012.

The court also, however, ruled that the proposed enforcement provision is invalid. The stricken rule would have automatically made the failure to post the notice an unfair labor practice under the NLRA.

The Chamber of Commerce, the plaintiff in the case, has appealed.
