On High-School-Education Discrimination

As we’ve noted before, the EEOC has provided guidance on when it is–and isn’t–appropriate for employers to require a high-school diploma for a job. After causing a stir with its informal letter last fall, the EEOC followed up with a Q&A aimed at clarifying its guidance.

The biggest takeaway: it’s not illegal to require a high-school diploma for a position, you just need to be mindful of any ADA-protected disabilities that may have prevented the applicant from getting a diploma while making sure the requirement has some reasonable relation to the position.
