Certain Government Employees Can Now Keep Guns in Cars

Effective July 1, 2012, localities must now allow employees to keep guns and ammunition locked in their cars on workplace property.

While private-sector employers can restrict all gun possession on their property, including their parking lots, governmental employers are subject to different rules under the U.S. and Virginia Constitutions. In Virginia, they may only restrict gun possession in “sensitive” areas after balancing the risks and whether they justify restricting individuals’ rights to keep and bear arms.

However, the General Assembly stepped in last session and said that counties, cities, towns, and certain other public entities have to allow employees to keep guns and ammunition locked in their cars during the workday.
